DE - Police lieutenant to sue Town of Milton
Rogers said because unfounded allegations of Cornwell’s improper conduct were made public, he is now suing the town for defamation.
“We also believe we have grounds for cause of action for intentional infliction of emotional stress,” said Rogers.
According to the Police Officers’ Bill of Rights, Cornwell has a right to seek compensatory damages, said Rogers.
He said punitive damages would also be filed in Sussex County Superior Court.
Rogers said all communications on Cornwell’s behalf are to be directed to him.
Milton Mayor Don Post removed himself from the investigation and decision-making process because he testified against both Phillips and Cornwell on the town’s behalf.
Post dismissed Cornwell’s charges, calling them “political opportunism,”because the case surfaced just days before the town’s municipal election.
