MO - Enforcing Junk Ordinances

According to the ordinance, if the police chief or other authorized law enforcement officer, such as the sheriff or his deputies, determines that a public nuisance exists, the officer will deliver written notice to the owner, either in person or by registered mail. The notice will identify the offending condition, the date and time of the original inspection, and give the owner seven days to take care of the problem. If the owner cannot be located the written notice will be posted on the property.

However, the ordinance goes on to state that if the nuisance is on any road or highway or is creating a dangerous situation then officers may remove the nuisance immediately, then attempt to find the owner or person responsible and provide them with the cost for removing the nuisance. Any vehicles abandoned along the road will have a notice applied to the vehicle and will be removed within 48 hours. The owners will be responsible for the cost of removing the vehicle.

Fines for violating the ordinance are from $50 to $500. Each day the nuisance continues is considered a separate offense.

This ordinance takes priority over any previous ordinance.

My Thoughts:

This is an example of having city officials cross the line into our private lives.  What right does this city have to not allow ANYONE in the whole fricking town to have a broke down vehicle, a broken chair or a few fence boards in their yard?  How very very unconstitutional......
