Lawyer kicked in the head by cops, files lawsuit and nothing happens!
"I observed Zachary Bare still lying face down on the kitchen floor. He was yelling something at the trooper that I could not hear clearly,"Cockerham said. "The trooper was standing over him, to the left of Bare's prone body.
"The trooper said 'shut ... up' then suddenly stamped downward on the back of Bare's head with his right foot,pushing Bare's face into the kitchen floor," which Cockerham said appeared to be hard tile or linoleum. "I saw Bare lift his head and spit blood and teeth onto the kitchen floor."
Bare's teeth were not knocked out but rather were driven into his gums. Green said last week that Bare had undergone nasal surgery for the injury.
McCloskey said that when he transported Bare to the West Whiteland police station, Bare was spitting blood from his mouth while profanely complaining about the trooper who he said had kicked him. After investigators determined Bare had not been at the meth lab at the time of the raid, he was released after being treated by Uwchlan Ambulance Company for his injuries.
Bare has not been charged with any crime involving the meth lab.
Green filed a notice of his intention to sue in August. The court record in the matter includes reports from West Whiteland police officers about the events surrounding the alleged assault, including a statement in which Cruz is alleged to have acknowledged striking Bare. In that report, Detective Joseph Catov reported Cruz had told him on the night of the raid that he "had to go hands-on with the guy," meaning Bare.
